Terms of Service

Effective Date: October 19, 2025

1. Acceptance of Terms

By accessing and using FreightByUs ELD services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our services.

2. Service Description

FreightByUs provides:

• FMCSA-compliant Electronic Logging Device (ELD) hardware

• Cloud-based compliance management software

• 24/7 driver support services

• Automated IFTA reporting and fleet management tools

• Real-time GPS tracking and route optimization

3. Subscription Terms

3.1 Billing

Subscriptions are billed monthly or annually in advance. Pro and Elite Fleet plans require a 6-month deposit. Hardware activation fee of $192 applies to monthly Basic Compliance plans (waived for annual subscriptions).

3.2 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Deposits are refundable after 6 months of continuous service.

3.3 Refunds

We offer a 30-day money-back guarantee for new subscriptions. Hardware must be returned in original condition for full refund.

4. User Responsibilities

• Maintain accurate and current account information

• Ensure proper installation and use of ELD hardware

• Train drivers on proper ELD usage

• Comply with all FMCSA regulations

• Protect account credentials and report unauthorized access

5. Hardware Terms

5.1 Ownership

ELD hardware remains the property of FreightByUs until fully paid. After 12 months of continuous service, ownership transfers to the customer.

5.2 Warranty

Hardware is warranted against defects for 3 years from activation date. Warranty does not cover damage from misuse, accidents, or unauthorized modifications.

6. Limitation of Liability

FreightByUs shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. Our total liability shall not exceed the amount paid by you in the last 12 months.

7. Compliance Disclaimer

While our ELD solution is FMCSA-registered and compliant, ultimate responsibility for compliance with Hours of Service regulations remains with the motor carrier and driver.

8. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email. Continued use of the service after modifications constitutes acceptance of the updated terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
